Shipping Legality
|
The shipment of alcoholic beverages across state lines has become a hot topic in our industry. Many states have legislation prohibiting the transport of your wines across state lines. In our opinion, the main legitimate legal issue relates to the potential for people under 21 years of age to illegally receive alcoholic beverages. We are extremely concerned about this problem, and take multiple precautions to ensure that people under 21 will not receive alcoholic beverages. One of these precautions is the fact that shipments from K&L Wine Merchants are sent with an "Adult Signature Required" sticker and proof of age must be presented at the time of delivery. We're as upset as you are regarding the inconvenience that current legislature may cause many law-abiding residents in certain states. It is our hope that a continued fight from retailers, wineries, and others will eventually result in a fair and justifiable resolution. For additional information on this topic, we'd encourage you to visit two Web sites... the Wine Institute and Free the Grapes. And now, a word from our our lawyers... Every sale K&L makes is made within California, and non-California residents are responsible for determining whether they may lawfully import alcoholic beverages into their state. We make no representation relative to your right to import wines or spirits into your state. Each state has its own rules regarding alcoholic beverages. You may want to check with the appropriate agency in your state or county. If, between the date of order and date of arrival, the laws of your state change so as to make it illegal to receive the shipment, you can return the order for a full refund. K&L Wine Merchants will arrange for shipment on behalf of the buyer, to an address specified by the buyer, provided that K&L Wine Merchants in its sole judgement believes that such shipment will not subject K&L to the risk of any sort of legal action or other harm. If a buyer lives in a state where the direct shipment of wine by K&L violates the law, we suggest that the buyer provide an alternative address in another state or have their wine shipped to a third-party storage facility in a direct shipping-friendly state. As a service to our buyers, we have compiled a listing of these facilities, which are not affiliated with K&L. We do not provide an endorsement of any facility and we recommend that you contact the facility directly to determine if their costs and services meet your needs. Third party storage facilities within states we CAN ship to...
